PARTY WALL AWARDS

The Party Wall etc Act 1996 provides a framework for preventing and resolving disputes in relation to party walls, boundary walls and excavations near neighbouring buildings. A building owner proposing to start work covered by the Act must give adjoining owners notice of their intentions in the way set down in the Act.

You must tell your neighbours if you want to carry out any building work near or on your shared property boundary, or ‘party wall’ and there is a strong chance you will need a party wall award.

What is a party wall?

A party wall stands on the land of 2 or more owners and can either:

form part of a building, or, don’t form part of a building, such as a garden wall (not wooden fences)

Walls on one owner’s land used by other owners (2 or more) to separate their buildings are also party walls.

You can also have a ‘party structure’. This could be a floor or other structure that separates buildings or parts of buildings with different owners, eg flats.

The aim of the Party Wall etc 1996 is to enable building work to take place whilst protecting the neighbours around the project.
