RIGHTS TO LIGHT

A "right to light" is an easement that gives a landowner the right to receive light through defined apertures in buildings on his or her land.  The affects of a loss of light to a building can be serious and affect the value of a property considerably.  At ASP we are appointed by both developers and land owners alike and offer advice on potential loss of light claims whether they are from a 10 storey building or a large extension.  Recently we have successfully achieved awards for the following cases:

  • Numerous individual owners in one block of apartments in the City of London

  • A developer who had their own building affected by a neighbouring council development
